Terms of Service

These Terms of Service ("Terms") govern your use of the Triathlon Race Day Checklist mobile application ("App") operated by Neon Peach, LLC ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Use of the App

The App provides triathlon race-day checklist management, including creating checklists, tracking race history, and storing race-day photos. You must be at least 13 years old to use the App.

You agree to use the App only for its intended purpose and in compliance with all applicable laws. You are responsible for maintaining the confidentiality of your account credentials.

2. Accounts and Authentication

The App uses third-party authentication providers (Apple Sign-In, Google Sign-In) to create and manage your account. By signing in, you authorize us to access the basic profile information provided by these services (name, email address).

You may delete your account at any time through the App's Settings. Deleting your account removes your profile data from our servers and erases your locally stored data (checklists, race files, and photos) from your device.

3. Subscriptions and Payments

The App offers optional auto-renewable subscriptions ("Pro") that unlock premium features. Subscription details:

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings.
  • Any unused portion of a free trial period is forfeited when you purchase a subscription.

Prices are in USD and may vary by region. We reserve the right to change subscription pricing. Any price changes will take effect at the start of the next subscription period following the date of the price change.

4. Intellectual Property

The App, including its design, features, and content (excluding user-generated content), is owned by Neon Peach, LLC and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

5. User Content

You retain ownership of any content you create in the App (checklists, race data, photos). By using the App, you grant us a limited license to store and process your content solely to provide the App's functionality.

You are responsible for ensuring that your content does not violate any third-party rights or applicable laws.

6. Data Storage

Your checklists, race data, and photos are stored locally on your device. Only your account profile is synced via cloud services (Firebase) to enable account features. We do not sell your data to third parties.

7. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. The App is a checklist tool and does not provide medical, safety, or athletic training advice. You are solely responsible for your race-day preparation and safety.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Neon Peach, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

Our total liability for any claim arising from or related to the App shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Neon Peach, LLC and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the App or violation of these Terms.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the App. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App ceases immediately.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
